By purchasing, downloading, installing, or using our WordPress plugin (hereinafter referred to as “the Plugin” or “the Service”), you agree to comply with and be bound by the following Terms and Conditions. If you do not agree with any part of these terms, you must not purchase, download, or use our Plugin.

The terms “we”, “us”, “our”, or “Image Marquee” refer to the owner of the website and software. The terms “you”, “user”, “customer”, or “licensee” refer to the purchaser or user of our Plugin.

1. Order Processing and Licensing via Freemius

Our order process, licensing management, updates, and premium distribution are conducted and handled by our online reseller Freemius, Inc. (Freemius.com).

  • By purchasing a Premium License, you agree to be bound by Freemius’s Terms of Service and Privacy Policy in addition to these Terms.

  • Each license grants you a limited, non-exclusive, non-transferable, and revocable right to use the Plugin on the number of WordPress sites specified in your chosen plan.

  • Sharing, reselling, renting, or redistributing your license keys or modifying the code to resell the Plugin independently is strictly prohibited.

2. Payments, Automatic Renewals, and Cancellations

  • Payments: All payments are securely processed through Freemius using authorized payment gateways (such as Stripe or PayPal).

  • Subscriptions: Premium plans are billed on a subscription basis (monthly or annually) or as a one-time lifetime payment, depending on the plan you select.

  • Renewals: Subscription plans renew automatically at the end of each billing cycle unless cancelled. You can cancel your subscription at any time prior to the renewal date through your Freemius Account Dashboard. Cancellation ensures you will not be billed further, but your premium features and updates will expire at the end of the current paid period.

3. 7-DAY LIMITED “MONEY BACK GUARANTEE” & REFUND POLICY

We stand behind the quality of our Plugin, but because it is a digital product with immediate access to the source code, we enforce a strict and conditional refund policy. We offer a 7-Day Limited Money-Back Guarantee under the following precise conditions:

  • Eligibility Criteria (Bugs & Unresolved Issues): Refunds are only granted if the Plugin has a technical bug, malfunction, or compatibility issue that prevents it from working correctly on your website, and our support team is unable to resolve or fix the issue after being notified.

  • The Troubleshooting Process: Before a refund is considered, you must open a support ticket via your Freemius dashboard and allow our technical team a reasonable opportunity to troubleshoot, diagnose, and fix the problem.

  • Timeframe: Any refund request based on an unresolved technical issue must be submitted within exactly 7 calendar days from the date of your initial purchase.

    • Absolutely no refunds will be issued after the 7-day window has expired, under any circumstances.

    • Refunds will not be granted for a change of mind, lack of use, missing features that were not advertised, or failure to read the product documentation/system requirements prior to purchase.

4. Support and Plugin Updates

  • Support: We provide technical support for premium license holders as long as their license remains active. Support is strictly limited to issues directly related to the Plugin’s core functionality. We do not provide support for third-party plugins, theme customizations, or custom coding.

  • Updates: Regular updates, including bug fixes, security patches, and compatibility improvements for new WordPress versions, will be delivered automatically through your WordPress dashboard via Freemius, provided your license key is valid and active.

5. Intellectual Property and Ownership

The Plugin, its code, design, branding, and all documentation found on https://www.imagemarquee.com/ are the exclusive property of Image Marquee. While the PHP portion of the code may be subject to the GNU General Public License (GPL), all proprietary assets, brand elements, and premium add-on logic remain protected by copyright laws.

6. Warranty Disclaimer

The Plugin is provided “as is” and “as available”, without warranty of any kind, express or implied. Image Marquee does not guarantee that the Plugin will meet your specific requirements, run uninterrupted, or be 100% compatible with all third-party themes, page builders, or hosting environments.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Image Marquee, its developers, or its suppliers be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, website downtime, loss of profits, or business interruption) arising out of the use or inability to use the Plugin, even if advised of the possibility of such damages.

8. Changes to These Terms

We reserve the right to modify or replace these Terms and Conditions at any time. Any changes will become effective immediately upon posting to this page. Your continued use of the Plugin after any modifications constitutes acceptance of the updated Terms.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Barcelona, Spain.
